Possession Readiness Review Service

Happily most notices to end a tenancy do not end up in court, as the Residents accept the notice and agree to leave the property. However if the residents do not agree to leave, then Court action is needed to force the eviction.

Over the last few years the courts have become increasing discerning about the level of detail needed when evicting a tenant. They set the bar high and assume that as the owner of the “business” letting the property the onus is on you to properly comply with all rules and details. Eviction cases have failed due to an inaccuracy on a postcode on a satisfactory gas certificate from several years ago, which the resident had accepted at the time.

As these expectations have evolved over time, unless you are regularly involved in such issues, you may well miss on an important detail. You may not discover this until you get to court, which could be months later than the original eviction date. This can obviously be very costly.

We have therefore created a Possession Readiness Review to look at all the things that need to be in place to ensure your claim at court is not rejected for an administration issue.

Obviously if we set up the tenancy and have managed it throughout, this service is not necessary, as we routinely cover these issues.
